UP RERA rejects application of 36 residential and commercial real estate projects

UPRERA rejects 34 residential and 4 commercial project registration application

UPRERA has rejected almost three dozen application of commercial and residential projects of developers as they either did not have maps sanctioned by competent authority or did not have the documentation in place. Now they need to re-apply for fresh registration with UPRERA after completing the lacking formalities.

Although, even after 2 years UPRERA seems toothless as builders and developers have no fear of RERA Law and most of the orders passed by RERA benches stand not complied. Although over 13000 complaints are filed against builders and in most cases the builder/developer is at fault but they rarely follow the orders passed by UPRERA. Buyers are left with no option but to knock the door of High Court or Consumer forum.

Summary of Recovery Certificate (RC) issued by UP RERA against builders to the tune of Rs. 185 crores

UP RERA came into force in 2016 in the Uttar Pradesh and since then it has heard cases in thousands. The UP RERA Authority has issued RC to the tune of Rs. 185 crores as on 18/05/2019 against builders who have defaulted in delivering their promise of providing dream homes to individuals. It is clearly laid down under section 40(1) of the Act, that order once passed has to be executed in the same way as it is been done under Land revenue Act.  Recovery under land revenue   is an altogether a different ball. In order to get due recovered under land revenue, a recovery certificate is issued by the concerned department or Authority as the case may which further is then sent to the SDM or DM in whose jurisdiction the property vests. Ansal API fined Rs. 1 crore by UP RERA, Escrow a/c details called for.

Ansal API fined Rs. 1 crore by UP-RERA The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has started to tighten it's grip on Builders and one of the example was set on Monday by imposing a fine to the tune of Rs 1 crore on Ansal API, for not following its order dated 25 October 2018. The builder has been given a time frame of one month to submit the fine. "The fine has been imposed to send our a message to all the builders that they have to comply with RERA orders", said Balwinder Kumar, UP-RERA member. The authority however decided to defer an even stricter measure of de-registering Ansal's six projects for four months subject to certain conditions.
